Department of Labor Issues Updated FMLA Forms

On July 16, 2020, the Department of Labor (DOL) released new Family and Medical Leave Act (FMLA) forms that were announced in August of 2019. These new forms can be used to comply with many technical nuances of FMLA, but, like prior versions, are completely voluntary.

  • WH-380-E Certification of Health Care Provider for Employee’s Serious Health Condition download
  • WH-380-F Certification of Health Care Provider for Family Member’s Serious Health Condition download
  • WH-381 Notice of Eligibility & Rights and Responsibilities download
  • WH-382 Designation Notice download
  • WH-384 Certification of Qualifying Exigency for Military Family Leave download
  • WH-385 Certification for Serious Injury or Illness of Covered Service member for Military Caregiver Leave download
  • WH-385V Certification for Serious Injury or Illness of a Veteran for Military Caregiver Leave download


The revisions to the forms were made in an effort to make them easier to understand, eliminate unnecessary questions, and reduce the administrative burden on both providers and employers. While employers are still free to use the old forms, they are cautioned not to ask for any information other than what is specified in FMLA regulations
